Judge: Under Joint, Several Theory, Contribution For Uninsured Periods Barred
SEATTLE - A Washington judge ruled Dec. 16 that an insurer agreeing to pay “all sums” an insured becomes legally obligated to pay cannot obtain contribution from other insurers that issued “fronting policies” to the insured given that Washington follows a joint and several allocation method (Weyerhaeuser Co. v. Fireman’s Fund Insurance Co., et al., No. C06-1189, W.D. Wash.; 2007 U.S. Dist. LEXIS 92521). Full story on lexis.com
