INDIANAPOLIS - The first Zyprexa case to go to trial ended with a March 26 announcement by Eli Lilly and Co. that it agreed to settle failure-to-warn and consumer law claims brought by Alaska for $15 million and parity with any future similar settlements with other state governments (state of Alaska v. $1M Punitive Damages Award Vacated; Katrina Suit Remanded For New Trial
NEW ORLEANS - Because an insurer’s investigation of a Hurricane Katrina claim was not negligent and the insurer had an arguable basis for denying a portion of the insureds’ claim, a $1 million punitive damages award entered against the insurer was not appropriate, the Fifth Circuit U.S. Court of Appeals said April 7 in vacating the award and remanding the case for a new trial (Norman and Genevieve Broussard v. state Farm Fire and Casualty Co., No. 07-60443, 5th Cir.).
