Prempro MDL Judge Throws Out $27.1M Punitive Damages Award, Orders New Trial
LITTLE ROCK, Ark. - The federal judge presiding over the Prempro multidistrict litigation yesterday reversed a jury’s $27.1 million punitive damages award to a woman who claimed that she developed breast cancer as a result of using Premarin, Prempro and Provera on the ground that the expert testimony provided by the plaintiff’s expert was improperly admitted and ordered a new trial (In re: Prempro Products Liability Litigation, MDL No. 1507, Donna Scroggin v. U.S. Supreme Court: ERISA Insurer’s Dual Role Creates Conflict Of Interest
WASHINGTON, D.C. - The U.S. Supreme Court on June 19 unanimously held that an ERISA long-term disability benefits plan insurer that both evaluates and pays claims acts under a conflict of interest but, in a divided ruling, held that the conflict should be considered as a factor in determining whether the plan administrator abused its discretion in denying benefits (MetLife [Metropolitan Life Insurance Company] and Long Term Disability Plan for Associates of Sears, Roebuck and Company v.
