Rhode Island Supreme Court Finds Paint Companies Not Liable
PROVIDENCE, R.I. - The Rhode Island Supreme Court on July 1 unanimously reversed the trial court verdict that had found that three former makers of lead paint were liable for the costs of abatement with respect to lead paint hazards in the state, ruling that the public nuisance claim should have been dismissed at the outset of the case because the state has not alleged that the defendants’ conduct interfered with a public right (state of Rhode Island v.
