MINNEAPOLIS - An Eighth Circuit U.S. Court of Appeals panel on April 9 denied certification for the second time to a consumer protection class alleging injury from St. Jude Medical’s Silzone-coated heart valves, holding that individual issues predominate despite the lower court’s ruling that Minnesota law controls all claims (In Re: St. Jude Silzone Heart Valve Products Liability Litigation; Lester Grovatt, et al. v. SAN FRANCISCO - Automatic teller machine (ATM) cardholders’ challenge to the setting of a fixed interchange fee that a bank pays when its customers use ATMs owned by other institutions must be analyzed under the rule of reason, a federal judge in California ruled March 24 (In re ATM Fee Antitrust Litigation, No. C 04-02676 CRB, N.D.
